This section outlines the terms of service for our website, angelsarmoryforge.com and for live online auctions, detailing crucial aspects such as customer obligations, product descriptions, and service agreements. Please take the time to read through these terms carefully to understand your rights and responsibilities before placing a bid or making a purchase.

 

TERMS & CONDITIONS - BIDDING CONTRACT - LIABILITY DISCLAIMER & AGREEMENT

 

THESE TERMS ARE APPLICABLE TO REGARDING OUR AUCTIONS AT

ANGELSARMORYFORGE.COM & ALL OUR OTHER SELLER SITES

(EXCEPT OUR E BAY & GUNBROKER AUCTIONS & SALES SITES).

Placing a Bid on an Auction: Buyer understands and agrees that placing a bid on an auction item or purchase by “Buy It Now” constitutes the Buyer creating a legally binding contract with the Seller, for the purchase of an item stated an auction or buy it now listing. Actions are not governed under the same rules as retail sales. In an auction the buying bid or price may be much lower than retail for a quick sale or disposal of bulk items.

Buyer agrees that all bids and purchases cannot be retracted or cancelled and buyer agrees auction rules prohibit cancellation of any bid and the buyer accepts all items “as is” at the time of sell and accepts all risk of making their item bid decisions based his/her review of pictures provided in the listing with limited item circumstances and exceptions;

Sometimes there are unusual circumstances or instances where an auction bid or buy it now purchase must be cancelled. The seller reserves the right to cancel any bid or purchase in such cases;

1. The item is no longer available.

2.  The item was damaged or the item condition changed, prior to shipment, such as being broken or damaged during storage, handling or shipment preparations.

3.  The Item was stolen or confiscated prior to shipment.

In event a cancellation becomes necessary the bidder/buyer agree that seller shall not suffer any penalty for cancelling a bid or buy it now purchase, as indicated by their bidding or purchasing an item.

Buyer further understands and agrees that if Buyer’s bid is the winning bid, Buyer shall complete the purchase of the Item, and that Buyer’s purchase will be subject to all terms stated by the Seller in the Listing and the terms of this User Agreement.

TYPE OF TRANSACTIONS: New and used firearms and gun parts are offered for sale by competitive bidding and for immediate sale using a Buy It Now Option, this is called an auction. In an auction, firearms and gun parts are often offered for sale at a much lower price than normally sold for at retail, when there are a lot of items are for sale, or when the seller desires to move merchandise rapidly. In such cases auctions are of economic benefit to the buyer.

APPLICABLE TO NEW GUNS, USED GUNS & GUNPARTS; We recommend that all items be inspected by a qualified gunsmith before use, installation, loading or firing, since new and used guns, can have issues we do not know about as can gun parts. We do not know the history of guns or parts we obtain from other individuals, gun shops or dealers. If the auctioneer is aware of a problem he will state it in the auction listing. When rapidly listing firearms and gun parts for auction a defect might not be noticed, so please have guns inspected. No Refunds, No Returns, No Warranty Whatsoever.

WAR TIME GUNS – HISTORICAL RELICS: Buyers agree that all war time guns are sold as historical (non-firing) relics, for parts use and as wall hangers. We cannot make any guarantee regarding war time guns. Buyer's agree not to load any war time gun until the gun has been thoroughly inspected and determined safe by a competent gunsmith.

SAFETY WARNING & NOTICE APPLICABLE TO FIREARMS, GUN PARTS & PART GUNS; We suggest firearms, firearms parts guns and individual gun parts be inspected by a competent gunsmith before application, installation or using a firearm, firearm parts gun, or repairing a gun with used parts. Firearms, parts guns and parts are sold either with all parts present or with parts missing. If the seller is aware parts are missing, it will be stated in the auction listing. Used firearms, part guns and parts are sold and are they should not considered safe to load or fire, until properly inspected, evaluated and/or repaired by a qualified gunsmith. Property damage, serious injury or death may occur from failure to use a gunsmith for inspections, evaluations and repairs.

RETURNS & REFUNDS: All items are sold “AS IS”.  No Refunds, No Returns and No Warranty Whatsoever.

PAYMENT DUE: All internet online credit card payment for items must be made within close of the auction, or you must communicate to us if you intend to pay by check or money order and there will be a delay.

APPLICABLE TO ALL GUN SALES, FRAMES & RECEIVERS; All antique and modern firearms sold by us require a FFL. Air Rifles and Black Powder firearms do not require a FFL. Buyer's agree to submit a copy of their designated FFL via e mail,  that we will ship to after the auction. We do not ship to Curio License Holders.

LIABILITY WAIVER; When buying a firearm or gun part from us, you agree to have the gun, parts gun or parts inspected by a competent Gunsmith and you specifically release us from any liability from your failure to use a gunsmith to evaluate, adjust, install or other ensure the items safety. This release is affirmed by you placing a bid or making a purchase.

FIREARM INSPECTIONS SAFETY NOTICE: We do not have staff to disassemble, clean and inspect all the guns or parts that we sell. Such inspections would substantially increase the offered for auction or buy it now sale price. We recommend all firearms be inspected by a qualified gunsmith prior to loading, firing or using to ensure the firearm is in safe operating condition. Failure to do so may result in property damage, injury or even death. You specifically release us from any claim of liability in such instances when you place a bid or make a purchase.

ALL GUNS & PARTS ARE SOLD AS-IS; All part guns, used firearms and new firearms are sold AS-IS. No Refunds, No Returns, No Warranty Whatsoever. We do not specify a firearms or parts cosmetic appearance other than to specify the item is used. The buyer should expect storage, handling or use wear and may have blemishes, dings, marks, scratches, discolorations, and common used item wear. If we know of a mechanical problem with the gun part, we state it in the description. 

STATEMENT OF NO WARRANTY: New gun customers may have an applicable warranty from the manufacturer, but there is no warranty whatsoever by Dwight Angel, DANGELCO Dwight Angel Company, Angels Armory & Forge, and/or US Weapons Auction.

READ DESCRIPTIONS OF FIREARMS BEING AUCTIONED; Please read the descriptions of firearms before placing a bid or using the buy now option. We list pictures of every firearm or gun part that we auction or sell. Use the pictures to judge the firearm’s or gun parts condition. We do not specify the firearms or gun parts cosmetic appearance. Use the pictures provided in a listing to judge the used gun or part condition. Buyers should not consider used guns or parts to be in excellent condition, they are used. If you have a concern or question, ask before bidding or buying a gun. 

LIABILITY WAIVER: WHEN BUYING FROM AUCTIONS YOU AGREE TO WAIVE LIABILITY & HAVE GUNS & PARTS PROPERLY INSPECTED AND/OR REPAIRED AS NEEDED; By placing a bid, the Buyer acknowledges and agrees that the Seller will not be held responsible for any property damages, personal injury, or death resulting from a broken or damaged item, inproper part installation, misuse of an item, or by the customer disregarding warnings and disclaimers, or from the failure to have the firearm or part properly inspected and installed by a competent Gunsmith.

BUYER COMPLIANCE WITH TERMS & LAWS; Buyer agrees to comply with all terms of auction outlined in the firearms listing, including item offered by DANGELCO Dwight Angel Company, Angels Armory & Forge and US Weapons Auctions. The buyer agrees to comply with terms and specifications as set forth by in our terms and conditions. The buyer affirms that he or she is in total compliance with all applicable laws regarding the purchase and receipt of a firearm.

SHIPPING - We do not ship to California, Alaska, Hawaii, Puerto , APO's or other military facilities. 

INCREASED SHIPPING COSTS; Please be aware if you live in Arizona, Nevada, North Carolina, South Carolina, North Dakota, South Dakota, a $20.00 increased shipping surcharge will apply to all shipments to these shipping locations.

FIREARMS SHIPPING INSURANCE; All packages are insured via USPS Priority for $100. Any additional insurance beyond the $100 is at the request of the customer and additional cost apply. Upon close of an auction the buyer must immediately communicate the desire for extra insurance in a e mail to us.

If you wish to have insurance coverage you must specify that to us in a separate e mail and add an additional fee of $ 3.00 per hundred dollars of coverage desired, payable by a separate check you mail to us for insurance. 

If you do not insure your purchase, we will not be held liable for damage or loss. Failure to obtain insurance or sufficient insurance will result in you accepting all loss in event of damage, theft or incidents in shipping.

ITEMS LOST, STOLEN OR DAMAGED IN SHIPPING; If we ship an item and it is lost, damaged or stolen during shipping, you must communicate that to us. We will provide you with the tracking number and the proof of insurance amount the item was insured. In as much as you are on the receiving end and knowledgeable of what loss or damage took place, you agree to file the insurance claim with the post office and process all paperwork. We will notify ATF if an item was stolen during shipping, based upon your communication to us.

FIREARM SHIPPING TIME FRAMES & COST; If you purchase something on Saturday afternoon, or Sunday, it will not ship out until Monday, when the post office opens. We do our part to get the item to you as quickly as possible. The speed at which the carrier delivers an item it is out of our control. 

SHIPPING COST: We principally use new packing materials as well as specially purchased firearm or parts shipping boxes. Shipping is an added cost to us because of the use of boxes that we just purchase and do not charge you for as well as the cost of bubble wrap, handling and transportation costs.

FIREARM SHIPPING TO DEALERS ONLY; We ship by the US Postal Service Only. We ship firearms to federal licensed firearms dealers only. We do not ship to Curio/Relic Collector Licensed Persons.

OBLIGATION TO PAY FOR ITEMS; If you make an offer and it's accepted, accept a counter offer or win an auction, your obligated to pay for the item. In the event that you do not pay, you will be blocked from any future bidding, a complaint will be filed with the auction venue, and appropriate feedback will be left.

WE DO NOT CANCEL AUCTION BIDS OR BUY IT NOW SALES; We do not cancel orders, buy it now purchases, or cancel or remove sales or bids on auction items. Auction items are sold as is and are non- returnable.

APPLICABLE TO ALL GUN SALES; All firearms sold by us require a FFL. Buyer's agree to submit a copy of their designated FFL dealer license within (3) days of close of auction. The designated firearms dealer is where we will ship to after the auction. 

ISSUES WITH BIDS OR BUY IT NOW PUCHASES; In the event that there's an issue with your order or item, please contact us before leaving negative feedback. We may be able to remedy your issue. Please send us an e mail to (angel.dwight@yahoo.com) or phone call (850) 509-0979.

ENURE YOUR SHIP TO ADDRESSES ARE CORRECT; Please make sure your address is correct before purchasing. Please make sure the ship to dealer name and address is correct. We do not change ship to addresses and will only ship to the address you provided at checkout. We do not make returns. If we ship to an address you provided at checkout and we discover the address was incorrect and the item has to be returned to us, you will be responsible for additional shipping cost to have the item shipped to the new corrected shipping address.

RELEASE OF LIABILITY; By purchasing an item, entering a bid or making an offer, you (the Buyer) agree to release the seller from all liability, whether criminal or civil, arising from the purchase, ownership, possession, use or misuse of items purchased at auction. You further agree to all of the sellers terms set forth in these auction terms, auction sale terms and/or listings.

HOLDING ITEMS/WAITING FOR A SHIP TO FFL DEALERS LICENSE COPY WITH ADDRESS; An order that has been paid and awaiting a ship to FFL dealer license copy, will be held in secure storage no longer than fiteen (15) days, after the close of the auction. On the 16th day in secure storage, withot receipt of a dealer license copy to ship to, all monies, claims and rights to possession, will be forfeited to the auction business by the original purchaser. The purchasers agrees in totality to this provision and agrees that tere shall be no rights of recourse.

BIDDER/BUYER LIABILITY WAIVER AGREEMENT: The bidder, the buyer, the buyer's agent, and the buyer's estate, including the buyer's family and inheritors hereby release Dwight Angel, DANGELCO Dwight Angel Company, Angel's Armory & Forge and US Weapons Auction from any claim of liability resulting from the failure of the bidder/buyer to follow safety notices and warnings issued herein. This release shall include failure to use a qualified gunsmith to inspect and install parts. Such release shall be incumbant upon the bidder/buyer, the buyer's agent, and the buyer's estate, family and inheritors of the bidder/buyer. 

BUYER CONFIRMATION OF AGREEMENT TO THESE CONDITIONS, TERMS AND LIABILITY WAIVERS: If you do not fully agree with these terms and specifications do not bid, buy or purchase an item by bidding and/or buy it now sales. You indicate you are in complete agreement by placing a bid or making a purchase.

As a valued customer, you play a vital role in ensuring a respectful and transparent transaction process. It is your responsibility to provide accurate information during the registration and checkout processes. Furthermore, you agree to abide by all applicable laws when using our services.
